UPDATE: Implementation of Short-Term Rental By-Law is Delayed
Regulation of short-term rentals in Toronto is being delayed by several months due to an appeal to the Ontario Municipal Board (OMB) of the zoning by-law amendments. The OMB has yet to rule on these appeals, with hearings scheduled to take place on August 30, 2018. As a result of this appeal, the new 4% Municipal Accommodation Tax (MAT) on short-term rentals is also delayed. Short-term rentals are not permitted in Toronto until the zoning by-law and registration and licensing by-laws come into effect, which originally were scheduled for June 1, 2018.
Back in December 2017, Toronto City Council voted to regulate short-term rentals. The regulations would prohibit residents from listing any secondary suite other than their primary residence as a short-term rental. A cap on the maximum number of nights in a calendar year was set at 180 days.
TREB was involved in discussions on regulation of short-term rental housing. We support innovation in the economy and believe that, with fair and equitable regulatory oversight, the home sharing economy can provide valuable economic benefits. TREB did share concerns that have been raised by municipalities, and others, about the impact of the home sharing economy on the supply of affordable rental housing, and potential other unintended consequences such as impacts on surrounding property owners and/or tenants.
The City's decision to limit short-term rental housing to a principal residence is a good start. There are many angles to consider with regard to the sharing economy and the short-term rental market, not the least of which is fair taxation to ensure that all providers of short-term accommodation are treated equitably.

TREB Arbitration Update
In 2017, an Arbitration task force was formed with a mandate to review, assess, and evaluate the current Arbitration and Professional Standards policies and operations with a view to implementing measures that will improve operational effectiveness, reduce processing times, and ensure greater consistency in disciplinary outcomes.
Consideration was focused on the content of the Arbitration Claim Form and Arbitration Guidelines. The Board of Directors approved updates to the Arbitration Claim Form and Arbitration Guidelines, effective March 29, 2018.

Mandatory Provincial Residential Tenancy Agreement
As part of Ontario's Fair Housing Plan and Rental Fairness Act, the provincial government is introducing a new standard lease that will be mandatory for private residential leases signed on or after April 30, 2018, including tenancies in single and semi-detached houses, apartment buildings, rented condominiums and secondary suites (such as basement apartments).

Recent Revisions to the OREA Form 400: Residential Tenancy Agreement (Standard Form of Lease)
OREA has made revisions to Form 400 in response to the new requirements per the Residential Tenancies Act. The Form #400 revisions are as follows:
Clause 12; first line was revised to identify the lease will be drawn by Landlord on the standard form of lease as per Residential Tenancies Act (RTA) &
Clause 13; is a new clause for party (landlord and tenant) acknowledgement that there will be a standard form of lease as prescribed by RTA. All form Clauses were re-numbered thereafter.
Note: The purpose of OREA Form #400 Agreement to Lease - Residential is as a negotiating tool only and the mandatory government standard lease form for landlords is the actual formal lease document.
Further, three OREA Standard Clauses were deleted due to effects of RTA amendments; OREA Standard Clauses in LEASE/RES Clause 2, 8 & 14
Other Important Information
It is important to note that this standard lease form does not apply to most social and supportive housing, retirement and nursing homes, mobile home parks and land lease communities, or commercial properties. The government will develop separate standard leases to address these other types of residential tenancies.

Sign By-law Compliance – City of Mississauga
The City of Mississauga has advised TREB that it is receiving numerous complaints regarding the installation of real estate type signs. TREB strongly encourages Members to ensure that they are in compliance with all municipal sign by-laws. TREB works to ensure that municipal by-laws allow for an efficient marketplace; non-compliance by Members can result in stricter by-laws or complete bans.
The City of Mississauga has advised as follows:
Signs displayed in the City of Mississauga are regulated by Sign By-law 54-2002. Signs displayed in contravention of the By-law will be removed by City staff and/or charges laid against the agent, broker and property owner pursuant to the Provincial Offences Act without further notice.
By-law provisions include, but not limited to:
- Real estate signs are not permitted to be displayed on public property, including public fences between municipal streets.
- Directional "house for sale" signs are not permitted.
- Real estate signs cannot exceed 1 m2 in area on residential zoned properties and 4m2 on non-residential zoned properties.
- Only one (1) real estate sign is permitted to be displayed per street line.
- Banner signs are prohibited.
- The display of a sign or advertisement on a vehicle or trailer parked or located for the primary purpose of displaying the sign or advertisement is prohibited.
- Open house signs are not permitted to be displayed on traffic islands or medians.
- Open house signs are only permitted to be displayed during the hours of the open house.
- "Coming Soon" signs are not permitted.
- "Sold" signs are not permitted. (This includes the current practice of placing sticker or other "sold" indicator on a "for sale" sign. The Mississauga by-law only allows signs advertising the sale of a property and once it is sold it is no longer for sale. THIS IS NOT A NEW RULE AND HAS BEEN IN PLACE IN MISSISSAUGA SINCE 2002.)
City of Mississauga officials have also indicated to TREB that they are receiving numerous complaints about the placement of open house signs and are strongly encouraging TREB Members to comply with the by-law in this regard, and have indicated that non-compliance may result in serious enforcement or regulatory changes.

EVENT RECAP: Commercial Development Forum – Durham Region
TREB's third Commercial Development Forum took place for the first time in Durham Region on Friday, May 4, 2018 at the Deer Park Golf and Banquet Facility in Ajax.
The event drew a packed house of close to 200 attendees, who came out to learn more about the major commercial and infrastructure developments taking place in Durham Region and the broader Greater Golden Horseshoe (GGH).
Among those who joined the TREB Members in attendance were Members of the Durham Region Association of REALTORS®, representatives from real estate industry affiliates, and officials from all three levels of government.
OPENING REMARKS
TREB President Tim Syrianos served as host and kicked off the event by extending a warm welcome to attendees before introducing a series of esteemed guest speakers to the stage to offer their individual remarks, sharing brief statements and thanking TREB for hosting the forum and opening such an important dialogue for Durham Region. These speakers were:
- Dennis Roberts, President, Durham Region Association of REALTORS®;
- The Honourable Tracy MacCharles, Ontario's Minister of Government and Consumer Services;
- Lorne Coe, Member of Provincial Parliament, Whitby–Oshawa; and
- Garry Cubitt, Chief Administrative Officer, Durham Region.
MAIN PRESENTATIONS
KATHY WEISS
The first of the event's main presenters was Kathy Weiss, Durham Region's Director of Economic Development and Tourism, who spoke on growth and innovation in Durham Region. Weiss shared a local and regional government perspective on the investment opportunities and economic achievements of the GTA's most eastern municipalities.
JUDY PFEIFER
Next to the stage was Chief Communications and Public Affairs Officer at Metrolinx, Judy Pfeifer. Pfeifer provided an update on the transit developments in Durham Region and the broader GGH. From the Bowmanville Rail Extension and Durham–Scarborough Bus Rapid Transit line, to an overview of improvements to GO service and the broader Metrolinx commuter experience, Judy's presentation was in-depth and informative. Pfeifer's presentation also touched on the relationship between transit and real estate, particularly how public transit can influence property values and foster more livable communities.

RAY WONG
Ray Wong, Vice President of Data Operations at Altus Group Data Solutions and nearly 30-year veteran of the commercial real estate industry, concluded the main presentations segment of the event with an overview and outlook on the economy. Wong's data-driven presentation offered an informative summary on the commercial sector, detailing everything from how investment activity varies across the GTA, to providing numbers on office vacancy rates, and more.

CLOSING REMARKS
TREB Board of Director and Chair of TREB's Commercial Committee, Gareth Jones, provided brief closing remarks. After thanking the speakers, as well as those in attendance, for helping make the event a success, Jones invited everyone to visit the Exhibition area to network and learn more about the commercial real estate services offered to TREB Members.
