MEMBER ALERT: Open House Safety

A Member has reported that the owner of one of his listings in the Aurora Heights, Aurora area, informed him last week that three individuals were at her driveway, and one man started to check the doors and peep in the windows of the property. The female seller was scared since no appointments were booked. She shouted at them through the window, and they quickly left. The people returned around 5:30 p.m. and were greeted by the seller's husband coming home from work. He asked them if they had appointment with a sales representative; however, they hurriedly returned to their car and left. They are described as two males, both approximately 5'8", and one female, and they drove a white 4-door sedan.

It is not known if their intentions were to burglarize the home if they discovered no one was home or if they were casing the home for a future open house visit.

Regarding open houses, Members are reminded to carry their cell phones with them at all times; consider keeping a guest registry at all open houses, requesting visitors' identification as part of this process; and to accompany buyers throughout showings where possible. In addition to safeguarding their own possessions, it is suggested that Members also advise their clients to remove valuables from the home, including jewellery and electronics, prior to any showing rather than attempting to hide them.

EVENT RECAP: TREB Hosts Final Economic Summit of 2018 in York Region

On Monday, April 9, TREB hosted its third and final Market Year in Review, Outlook & Economic Summit of 2018 in York Region.

The sold-out event, which took place at the Cardinal Golf Club, drew nearly 100 attendees who came out to hear presentations on the real estate market in York Region and the broader Greater Golden Horseshoe, as well as research on the relationship between housing diversity, supply, and affordability in the GGH.


OPENING REMARKS

After providing a brief update on key TREB initiatives, TREB CEO John DiMichele kicked off the event's proceedings by offering opening remarks. DiMichele thanked those in attendance and noted how the Summit built on the research published in TREB's third annual Market Year in Review and Outlook Report released earlier this year (click here to read).

Host of the summit, TREB President Tim Syrianos, also provided opening remarks before welcoming a series of esteemed guest speakers from York Region to the podium.

Geoffrey Dawe, Mayor of Aurora; Virginia Hackson, Mayor of East Gwillimbury; and Vito Spatafora, Deputy Mayor of Richmond Hill, were all present to offer opening remarks and thanked TREB for inviting the municipalities of York Region to participate in the event.

In an exciting addition to the lineup, The Honourable Chris Ballard, Ontario's Minister of the Environment and Climate Change, was also welcomed to the stage to provide brief remarks.


MAIN PRESENTATIONS 
Paul Smetanin, President and CEO of the Canadian Centre for Economic Analysis (CANCEA), was welcomed back to the podium to deliver a presentation on missing middle housing. He discussed the interplay between housing density, diversity, and supply, and how it's critical to understanding and addressing the housing affordability issues in the Greater Golden Horseshoe.

Also on hand to present on the market were Jason Mercer, TREB's Director of Market Analysis and Service Channels, and Sean Simpson, Vice Present at Ipsos Public Affairs. Mercer focused on providing a data-driven outlook for the GTA and York Region housing markets, while Simpson presented updated consumer research from Ipsos, including data pointed specifically at York Region.

Following the presentations, the audience was invited to pose questions to the Summit's speakers.

REALTORS® Raising Concerns over Cannabis Legalization

As the federal government prepares to legalize the possession, distribution and growth of cannabis in residential homes, Realtors across Ontario want to ensure that the provincial government is taking steps to protect home buyers, sellers and owners.

The Ontario Real Estate Association has developed an Action Plan for Cannabis Legalizationthat outlines five policies to protect consumers from the risks involved in purchasing a former grow operation. The Action Plan is part of a public relations campaign focused on concerns with health and safety issues related to cannabis cultivation in private residences.

The five policy changes to protect consumers from the risks involved in purchasing a former grow operation, include:

  1. Designate illegal grow operations as unsafe under the Building Code Act;
  2. Mandate that former illegal cannabis operations are inspected by a municipal building official;
  3. Require municipalities to register remediation work orders on the title of a former grow operation;
  4. Mandate that all licensed home inspectors receive training on how to spot the signs of a former marijuana grow operation; and
  5. Restrict the number of plants that a homeowner can grow from four to one in units 1,000 square feet or smaller.

Affordable Units in New Residential Developments

As part of the Promoting Affordable Housing Act, starting on April 12, 2018, Ontario municipalities will have a new planning tool at their disposal to encourage the creation of more affordable housing units – inclusionary zoning. The provincial government has announced that it is giving municipalities the ability to require developers to include affordable housing units for low- and middle-income families in new residential developments through inclusionary zoning.

The new inclusionary zoning by-laws will apply to developments of 10 or more units, although municipalities could choose to set a higher threshold based on local circumstances. Inclusionary zoning can also be applied to any type of residential development – both ownership and rental – based on local needs and priorities.

Each municipality will have the flexibility to decide the total number of affordable housing units to be included in some residential developments, how long units stay affordable, and what measure and incentives can be used to offset the costs of the development of those units.

MEMBER ALERT: Suspicious Buyer

A Member reported receiving an online lead for a buyer looking for a property in the $8 to 9 M range. The email showed a picture of a couple with an address in Thornhill; however, she was concerned as the email appeared to have originated from the US, and the phone number supplied was 'not a working number' with the area code associated with Connecticut.

When she checked the Thornhill address, she found it was listed for sale, but the seller's name was different from the name of the person who had emailed her. She contacted the Listing Salesperson who confirmed that the email sender's name did not relate in any way to the Thornhill address. The Listing Salesperson called back a few hours later to say that an inquiry had come in on one of her high-end listings from the same people.

Concerned about possible email viruses and the discordant information, the Member did not open any of the attachments regarding the buyer's criteria, and she decided not to pursue the lead.

TREB wishes to remind Members to endeavor to verify the identity of potential buyers and sellers and to be cautious about opening any suspicious attachments or links. 

Members are encouraged to take appropriate safety precautions when meeting a client for the first time, including meeting at the office and verifying their identity, being accompanied by a colleague for showings where possible, keeping a mobile phone on hand at all times, and updating the office on your itinerary.

Update on Possible Vacancy Tax in Toronto

In May 2017, the City of Toronto was given the authority to impose a tax on vacant homes through the Ontario Fair Housing Plan. Subsequently, the City's Executive Committee instructed City staff to conduct consultations and to bring forward recommendations on how to implement this tax.

TREB has been working diligently on this issue to stress that policies targeted at the housing market should be evidence-based, and to point out numerous concerns with this proposal. TREB's efforts included meetings with senior staff in the Mayor's Office and key staff in the City's Finance Department who are responsible for drafting the recommendations to the Mayor's Executive Committee. City staff had been planning to bring forward recommendations at the end of November 2017, but the report got delayed.

At the recent meeting of the Toronto Executive Committee on April 17, it was decided that City staff should conduct further research on the potential tax on vacant homes in Toronto, and report back in 2019 after this year's municipal elections.

TREB is encouraged that the City is taking a thoughtful, thorough and evidence-based approach on this issue, and that our input is being carefully considered. We will continue to work with City Hall to ensure the voice of the real estate industry is heard on this matter.

New Browser Requirements for Stratus – May 1st

On Tuesday May 1, in order to comply with security standards, our system security provider will be turning off support for the dated TLS (Transport Layer Security) version 1.0. All Members who are presently using out-of-date browsers will need to install newer versions of those browsers which support the newer security protocols. Otherwise, logging into Stratus will become problematic. Also, as of June 30, TREB's e-Commerce website will no longer support the TLS 1.0 protocol. 

As we reported here on October 27, there is an ongoing industry-wide attempt to move away from the potentially vulnerable encryption protocol TLS (Transport Layer Security) version 1.0. Older Internet Explorer versions, older Safari browsers, and older Android phones only support TLS 1.0. Because they do not support the newer TLS protocols, use of these browsers has become increasingly problematic with new applications and websites that use newer versions of TLS only. 

If you are using any of the following browsers, you should upgrade the software at your earliest convenience:

  • IE 10 or below (current version 11)
  • Chrome Version 21 or below (current version 65)
  • Firefox 26 or below (current version 59)
  • Opera version 13 or below (current version 52)
  • Safari 6 or below (current version 11)

Also, anyone using an Android device with an OS of KitKat 4.4.4 or below (current version 8.1) will need to update their devices.

For accessing Stratus with a PC, you should be using one of the following browsers for best results:

  • Microsoft Internet Explorer 11
  • Microsoft Edge 41+ *
  • Google Chrome 63+ *
  • Mozilla Firefox 57+ *

For accessing Stratus with a Macintosh computer, you should be using one of the following browsers:

  • Apple Safari 10+
  • Google Chrome 63+ *
  • Mozilla Firefox 57+ *

* Note that Google Chrome, Mozilla Firefox and Microsoft Edge are updated regularly and the versions noted reflect the current minimum supported version as of the creation of this document.  As a rule, the latest three versions of these browsers are supported by Stratus.

Form 400, the OREA Residential Agreement to Lease has been revised (March 2018). Clauses 12 and 13 now make  reference to the provincial Standard Lease for Rentals.
