MEMBER ALERT: Caller Requesting Details After Sale

A Member has reported an unusual occurrence that took place on August 5. 

The Member recently represented a client, an Ontario numbered company, in the sale of a commercial property in W06.

Although only the company name was noted on the listing, the Seller received a telephone call at home from an individual who asked for her by name. The caller related information regarding the transaction, noted that the Seller was the signing officer for the company, and requested further details.

He claimed to be calling on behalf of a real estate marketing firm, indicating that he was collecting information for a database and requesting that the Seller provide her home address to be added to it.

The Seller did not provide any information and quickly noted the caller’s name and telephone number from call display. 

When the Member was alerted to this concern, she recalled receiving a similar inquiry within the past year after selling her own property.

The Member then attempted to reach the individual to discuss the August 5 inquiry and found that the number is not in service.

MEMBER ALERT: Luxury Buyer with False Documents

A Member has reported an unusual occurrence that took place on August 5. 

A Member has reported a concern regarding a Buyer who made an offer on an Oakville home listed for sale for $4 million, and failed to follow through with the deposit funds.

Prior to showing the home, the Listing Salesperson requested the Buyer’s financial documents through the cooperating Brokerage. The documents, which are confirmed to have been falsified, were from a major financial institution and reflected account balances from $3 to $6 million.

The Buyer provided two explanations as to how she acquired the funds, initially indicating she had received an inheritance and then stating she had been paid substantial funds for artwork she created.

After viewing the home on two occasions, she made an offer during the August holiday weekend, which was accepted. She failed to produce the agreed upon deposit of $400,000 on August 4, and on August 6, she signed a mutual release.

The Listing Salesperson subsequently learned that she also made an offer on a high-end condominium lease in C01 within the past month; however, it was not accepted. Additionally, she has recently viewed at least one other luxury condominium in downtown Toronto.

The individual is described as a 22-year-old woman, approximately 5’1” tall. She indicated that she is an art student who lives in Toronto with her parents.

Taking in Toronto’s landscape is like watching a scene through a vintage slide projector: signs of its metamorphosis are evident with the click of each new frame and every new sunrise.

A prime example of this growth exists throughout our city’s south core, or SoCo district, where several new office towers have sprung up in recent years, drawing some of the world’s biggest brands to their environs.

The new 31-story Bremner Tower, located just steps from the Metro Convention Centre, CN Tower and Rogers Centre, already houses Apple Canada Inc., and will soon be home to Amazon.

Next door is the 26-floor PwC tower, and neighbouring that is Telus House, a 30-storey office tower that in 2010 blazed a trail in businesses’ migration to the south core. Cisco Systems Inc., which last year announced a $100 million investment in Toronto as one of its four global innovation centres, is another key SoCo resident.

While corporations are drawn by modern office layouts, energy efficient features, and proximity to Union Station, aesthetics also play an important role in luring top talent; a point not lost on Royal Bank, which last year moved 4,000 employees to its new 30-floor headquarters, RBC WaterPark Place.

Sun Life Financial has also announced plans to move its offices to the south core next year. Its new headquarters will be a 35-storey building at One York Street.

Near Corus Entertainment’s waterfront headquarters, billions of dollars have been invested in mixed used developments planned for the East Bayfront, which in addition to condominiums and affordable rental housing units, will be home to an innovation centre and a creative industries hub.

Further east, on a former brownfield site adjacent to the Distillery District is Toronto’s newest neighbourhood, the Canary District.  This $514 million West Don Lands development includes a mix of condominiums, rental apartment buildings, George Brown College student housing, and a YMCA. It is anticipated that the community, with its expansive sidewalks, awarding winning 18-acre park Corktown Common, and 46,000 square feet of health and wellness themed retail space, will eventually include more than 6,000 residential units.  Its first role though, is to play host to the PanAm and Parapan Am Games’ 10,000 athletes, coaches and officials. After the Games come to a close, the buildings’ temporary walls and finishes will come down, to be readied for new permanent residents.

Another area that is home to sizable new condominium development lies near the foot of Yonge Street. In May, locals bid farewell to Captain John’s restaurant, a 90-metre ship moored at the base of Yonge Street for the last forty years. After a 15-year legal battle with the city, the ship was towed away to a marine scrapyard in Port Colborne. What lies ahead for this significant slip is as yet unknown, but one thing is certain: we can look forward to more exciting changes in our city’s landscape in the years ahead.

This year’s entertainment will feature The Big Sound, a tribute to Motown.

REMINDER: End of Paper-Based Versions of DLA, IDX and VOW Agreements as of September 1, 2015

On December 2, 2014, TREB released its new Online Agreement System which allows Brokers of Record and their Salespeople to complete DLA Agreements, IDX Agreements and VOW Agreements online instead of on paper. The TREB Online Agreement System provides a method of completing these agreements in less time, with less aggravation, and no paper waste.

Brokers of Record and their Salespeople now have more control over their agreements as the system also provides quick access to view their current active agreements, any agreements they have in progress, including where they are in the chain of process, and any active legacy paper-based agreements.

Accessible from the Forms/Clauses slider menu on the home page under REALTOR® TOOLS, this new system not only reduces the time it takes to get an agreement in place, but also the amount of paper it takes to do this, reducing TREB's environmental impact. Within the first four months of the Online Agreement System being available to TREB, over 1800 agreements were initiated online.

In March 2015, the Board opted to eliminate unnecessary paper waste by deciding to set a deadline for all DLA, IDX and VOW Agreements to be done online only. As of September 1, 2015 the use of paper-based versions of the DLA, IDX and VOW Agreements will come to an end and ONLY the agreements processed online will be accepted by TREB from then onwards.

Updated FINTRAC Materials and Forms

CREA's FINTRAC materials and forms have been updated. Minor clarifications and additions have been made regarding issues that have been brought to CREA's attention since the materials and forms were last updated in 2014.

The changes include:

  • Clarification on the types of records that need to be kept to satisfy the obligation to keep records of measures taken to monitor a Broker's business relationships. 
  • Revisions to reflect FINTRAC's recently published Guidance on the Risk-Based Approach to Combatting Money Laundering and Terrorist Financing and the recent Supreme Court of Canada FINTRAC decision with respect to lawyers. 
  • More information on suspicious transaction records and reports.
  • Minor formatting changes to CREA forms.

Revised CREA forms, which incorporate the changes, are available for download now onREALTOR Link® and will be available on WEBForms® on August 27, 2015.

Toronto Real Estate Board President Mark McLean announced that Greater Toronto Area REALTORS® reported 7,998 residential transactions through the TREB MLS® System in August 2015. This result represented a 5.7 per cent increase compared to 7,568 sales reported in August 2014.
